These Terms of Service govern your use of this website. They are not your construction contract. Any concrete work we perform is governed by the separate written estimate and contract you and Creative Concrete Company sign for that specific job.
Please note: Nothing on this website is a binding offer, a fixed price, or a warranty. Prices, timelines, and scope are set only in a signed written estimate for your specific property.
1. Acceptance
By accessing this website you agree to these Terms. If you do not agree, please do not use the site.
2. About Us
This site is operated by Creative Concrete Company, a family-owned concrete contracting business established in 1976 and based in Palatine, Illinois, owned and operated by Dave Stack.
3. Estimates Are Not Contracts
Content on this site — including service descriptions, project photographs, and answers in our FAQ — is provided for general information. It does not constitute a quote, a guaranteed price, or a commitment to perform work.
- All estimates require an on-site measurement and evaluation.
- Estimates are valid for the period stated on the written estimate. Material costs, particularly ready-mix concrete and fuel, fluctuate.
- Final scope, price, schedule, and payment terms are established only in a signed written agreement.
- Conditions discovered after excavation begins — buried debris, unsuitable soil, undocumented utilities, water intrusion, existing structural problems — may require a change order.
4. Project Photographs
Before-and-after and gallery images show actual work completed by Creative Concrete Company. They illustrate our workmanship but do not guarantee that your project will produce identical results. Concrete color, surface texture, and finish vary between pours due to mix, weather, humidity, and curing conditions. Minor variation in shade and finish is normal and is not a defect.
5. Concrete: Inherent Characteristics
Concrete is a rigid material that shrinks as it cures. In the Illinois climate it is also subject to repeated freeze-thaw cycles and de-icing salts. As a result:
- Hairline and minor cracking is normal and expected in all concrete flatwork and is not considered a defect. Control joints are placed to encourage cracks to occur in planned locations, but they cannot prevent cracking entirely.
- Surface color variation, efflorescence (white mineral bloom), and minor pitting can occur naturally.
- Applying de-icing chemicals — particularly during the first winter — can damage new concrete and may void any workmanship warranty.
- Ground movement, tree roots, drainage changes, and heavy vehicle loads can affect concrete after installation.
Any workmanship warranty we provide will be stated in your written contract, along with its duration and exclusions.
6. Communications With Us
Calling, texting, or emailing us does not create a contractual relationship or reserve a place on our schedule. Work is scheduled only upon a signed agreement. Standard carrier message and data rates apply to text messages you send or receive.
7. Intellectual Property
The Creative Concrete Company name, logo, site design, text, and project photographs are our property or used with permission, and are protected by copyright and trademark law. You may not reproduce, republish, or use them commercially without our written permission.
8. Acceptable Use
You agree not to use this site to attempt unauthorized access, transmit malicious code, scrape content for commercial republication, or interfere with the site's operation.
9. Third-Party Links
Links to Facebook, YouTube, and other external sites are provided for convenience. We do not control and are not responsible for their content, policies, or practices.
10. Disclaimer of Warranties
This website is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components. This disclaimer applies to the website only and does not limit any workmanship warranty stated in your signed contract.
11. Limitation of Liability
To the fullest extent permitted by Illinois law, Creative Concrete Company is not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of this website. Our total liability relating to the website will not exceed one hundred dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or personal injury caused by negligence.
12. Indemnification
You agree to indemnify and hold harmless Creative Concrete Company and its owner from claims arising out of your misuse of this website or violation of these Terms.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Any dispute relating to this website shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to that jurisdiction.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
15. Changes
We may update these Terms at any time. Continued use of the site after changes are posted constitutes acceptance. The "Last updated" date above reflects the current version.
